Please read these terms and conditions of sale carefully as they relate to all sales made by Brambles Delicatessen.

About us

Brambles Deli is a trading name of Brambles Delicatessen based at 48A St Mary Street, Kirkcudbright, DG6 4DN.

VAT Registration Number: 278824259.

Contract

When you place an order using our website, this is an offer by you to us to purchase these items. When we confirm your order, this is to indicate that we have received it. It does not indicate that we have accepted it. We will indicate acceptance of your order and hence a contract between us, when the order has been despatched.

Supply & Substitutions

Many of our suppliers are small-scale, artisan producers. For this reason, all products are subject to availability. If an item in your order is unavailable, we will substitute with an item of equal or greater value. If you would prefer us not to substitute, please send us a brief email at the time of ordering.

Payment

We accept payment by debit cards or credit cards with Visa and MasterCard. We use Paypal to process payments through their secure, encrypted gateway. The payment will be debited from your account upon receipt of your order. Completing the payment information and submitting the order implies authority to debit the relevant card.  

Shipping & Handling

£9.95 up to and including 1kg in weight;
£12.90 up to and including 2kg in weight;
£15.98 up to and including 5kg in weight.

Delivery Schedule

Goods will normally be received within 3-5 working days. Goods will be dispatched from Monday to Thursday by courier for next working day delivery. Orders received after 11am on Thursdays will be sent out the following Monday for delivery on Tuesday. All packages should arrive between 9am and 5pm and must be signed for. We cannot accept responsibility for goods that have been instructed to be left unsigned by the customer.

Cancellations

In relation to non-perishable goods only: You have the right to cancel your contract with us for the goods you order at any time from placing your order until 7 working days from the day after you received the ordered items. You must give us written notice of your cancellation by e-mail, fax or post. If you cancel your order following despatch of the goods, you must also return the goods to us. You must not unpack goods when they are received by you if you have already cancelled your contract. You must send the goods back to us at 48A, St Mary Street, Kirkcudbright, DG6 4DN at your own cost and risk as soon as possible. We will then refund your credit or debit card with the total value of your order (including delivery charges) within 30 days of cancellation PROVIDED that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. Until you return items to us, you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.

In relation to perishable goods and sealed items where the seal has been broken, you will not have the right to cancel your order once it has been despatched.

Returns

Everything we dispatch is in the best possible condition. If the goods you receive are damaged, defective or different from the goods you ordered, you will be entitled to either replacement goods or a full refund. All goods must be examined on delivery and any loss or damage must be notified in writing or by telephone within two days from the date of delivery. Where applicable, reasonable proof must be provided in order that we may claim from our insurers. After delivery, we cannot accept responsibility for any defect or damage to the goods caused by unsatisfactory handling or storage in unsuitable conditions. The cost of returning the damaged, defective or dissimilar goods shall be paid by us.

Retention of Title

All goods remain the property of Brambles Delicatessen until payment in full has been received and cleared. The risk of ownership passes to the buyer on delivery.

Events outwith our control

Whilst we make every effort to carry out the contract, Brambles Delicatessen cannot be held liable for cancellation or variation as a result of Force Majeure, War, Strike, Lockout, Labour, Dispute, Fire, Flood, Drought or other cause beyond our control.


Governing Law

This contract between us shall be governed by and interpreted in accordance with Scottish Law and the Scottish courts shall have jurisdiction to resolve any disputes between us.
